17 - 19 November 2021 took place IV International Conference of the Court of the Eurasian Economic Union ‘Ensuring Uniform Application of the Law of the Eurasian Economic Union: the Role of the Court’.
The Conference was opened by E.V. Hayriyan, Chairperson of the EAEU Court. The Conference was attended by the Member of the EEC Council and Deputy Chairman of the Government of the Russian Federation, the Chairman of the Board of the Eurasian Economic Commission, the Deputy Chairman of the House of Representatives of the National Assembly of the Republic of Belarus, the Ministers of Justice of the Republic of Armenia, the Republic of Belarus, the Republic of Kazakhstan, the Head of the Main Department of Cooperation of the Prosecutor General's Office of the Russian Federation, the Chairpersons and Deputy Chairpersons of the higher judiciary
Ivan Starikov, Antitrust Advisory lawyer, gave a presentation on ‘The EEC's powers to conduct investigations on its own initiative’. Ivan drew attention to some significant aspects in the work of the EEC (hereinafter - the Commission) that raise questions and require further consideration and elaboration. For example, in the last few years the EEC has been conducting investigations on its own initiative in various markets; the basis for an initiative investigation is a determination that is made when the Commission finds possible signs of violation of the general rules of competition in cross-border markets.
Ivan proposes to specify an approximate (open) list of sources from which the Commission receives such information. If an investigation is initiated as a result of any analyses (e.g., research studies commissioned by the Commission), it is essential that such analyses be published and that all interested parties have an opportunity to comment on them, and that the Commission considers and takes into account such comments.
