On 22 October, Antitrust Advisory partner Evgeny Khokhlov took part in the prestigious Forbes conference «Best Antitrust Practices 2021». The conference participants discussed the most topical issues in the field of antimonopoly law, including issues of price regulation, information transparency of the process of reviewing economic concentration transactions, the practice of court review of claims for damages caused by violation of antimonopoly legislation, etc.
Evgeny Khokhlov spoke at the session Judicial Practice in Russia: Recent Antitrust Cases and Court Histories with a presentation on ‘Proposed principles of functioning of digital markets by FAS Russia through the prism of law enforcement practice’. Evgeny outlined the main principles of interaction between participants in digital markets, which were approved by the FAS in September 2021 at the Expert Council for the Development of Competition in the Information Technology Industry.
‘The adoption by the Expert Council of the FAS of Russia of the Principles of Interaction of Digital Market Participants was a significant event in the antimonopoly sphere. The developed document is based on the principles of self-regulation. This approach is the most acceptable option for resolving disagreements on digital markets at the current stage of their development in Russia, as opposed to direct state regulation, which may not keep pace with the dynamic nature of competition on these markets.’
Evgeny tried to draw the attention of the conference participants to the Supreme Court's approach to economic analysis in antitrust cases and raised the question of judges' willingness to apply economic analysis in antitrust cases.
